THESE TERMS AND CONDITIONS APPLY TO:
Unity Garden Design services including concept work, site analysis, rendered, annotated and technical plans together with planting plans.
All quotations and the contract agreement.
1. DEFINITION
The ‘contractor’ means Unity Garden Design. The ‘client’ is the person or people who have requested the quotation and commissioned the contractor to carry out the work.
2. The Contract Agreement must be signed by both parties and returned to the contractor before any work commences.
3. Once the client has signed the quotation form, a binding agreement will form within the terms and conditions set out within this document. Any conflicting conditions shall have no enforcement. A contract is also formed upon a verbal discussion or alteration by the client with respect to previously agreed work. Both the client and contractor will receive a signed copy of these terms and conditions, which acts as a binding contract between the 2 parties.
4. Prior to any work commencing, a 50% deposit must be paid to the designer. Payment is made by methods outlined in the quotation. Fees are based on known conditions at the time of viewing. Travel expenses are allowed for in the quotation. Any unforeseen overnight expenses are chargeable to the client.
5. The ‘design’ incorporates all the work stated in the quotation. Any additional work or meetings will be charged at an hourly rate set by the contractor on agreement of this additional work. The standard work quoted is as follows:
Survey
Site analysis
Concept plan with up to two plan meetings (if required)
Presentation of the fully rendered and annotated plan
Technical plan – to be used by your chosen landscaper
Planting plan
It is at the discretion of Unity Garden Design if they decide on further site visits to check or re-evaluate details during the process, if the designer so wishes to spend more time evaluating the garden. This would be arranged at a mutually convenient time between the designer and the client.
5. Design revisions requested by the client are chargeable at an the standard hourly rate of £50 (calculated to the nearest 1/4 hour. Design revisions are also classed as concept revisions.
6. All design work commissioned is fully chargeable after the presentation of the fully rendered and annotated plan, regardless of whether the client decides not to have the project carried to completion. Fees are payable within 7 days of the invoice date. In the event of a cancellation before completion, work will be charged at the hourly rate including travel expensed, site visits, meetings, nursery visits, plant sourcing and any design work carried out.
7. Obligations of Unity Garden Design are solely limited to the design and plans submitted and they cannot be held responsible for faulty workmanship thereafter, even after Unity Garden Design have used a tendering process to introduce the client to potential contractors.
8. Unity Garden Design recommends that professional advice is undertaken for detailed structural work such as retaining walls, foundations, water tables/drainage and any other structural elements before any of the design work is implemented. The cost incurred by this are payable by the client. Unity Garden Design cannot be held responsible or liable by a clients decision not to take this advice and not consulting any such professional.
9. Unity Garden Design cannot be held liable for any indirect or consequential damage, including but not limited to, lost profits.
10. Quotations are valid for 30 days and could be subject to alteration after that date.
11. Unity Garden Design reserve the right to charge interest on late payment. Interest will be charged at a rate of 15% per week, which will be compounded. Charges will also apply for unpaid cheques in line with bank charges.
12. Project management after completion of the design and, if requested, is charged at the hourly rate as mentioned earlier.
13. All plans created by Unity Garden Design are their intellectual property and are protected from copying, scanning or sharing by the relevant copyright laws in the UK. All rights are reserved and designs remain the property of Unity Garden Design.
14. Plans and images of your garden may be used in future promotional work, unless specifically agreed otherwise.
